GROUP RIDE LIABILITY WAIVER AND RISK ACKNOWLEDGEMENT
By registering for or attending the Amidal launch ride, you confirm your understanding of and agreement to these terms and conditions. If you do not accept these terms, you should not participate. Thank you for helping us ensure a safe, enjoyable experience for everyone involved.
PLEASE READ CAREFULLY BEFORE SIGNING.
This agreement applies to participation in a cycling group ride co-organised and supported by POC Australia with the help of WONDERCROSS.
1. Voluntary participation and acknowledgement of risk
I acknowledge that my participation in the Ride is voluntary. I am responsible for assessing my own fitness and ability to participate.
I understand that cycling is a dangerous recreational activity and involves inherent risks, including but not limited to traffic, road and trail conditions, weather, mechanical failure, and the actions of other participants. These risks may result in serious injury or death.
I voluntarily accept and assume all such risks.
2. Release and limitation of liability
To the extent permitted by law, I agree that the Organisers are not liable for any loss, damage, or injury arising from my participation in the Ride, including where caused by the negligence of the Organisers.
Nothing in this agreement excludes, restricts, or modifies any consumer guarantee, right, or liability that cannot be excluded under applicable law, including under the Australian Consumer Law.
3. Conduct and safety
I agree to:
Follow instructions given by ride leaders or Organisers
Comply with all applicable road rules and regulations
Wear a properly fitted, approved cycling helmet at all times
Ride responsibly and with consideration for others
I understand that failure to comply may result in my removal from the Ride.
4. Organiser roles
I understand that the Ride may be organised or co-organised by multiple parties and that responsibilities may be shared. Nothing in this agreement increases the legal duties of any Organiser beyond those imposed by law.
5. Governing law
This agreement is governed by the laws of the Australian state or territory in which the Ride takes place, and the courts of that jurisdiction shall have exclusive jurisdiction.
